Not unconstitutional! The Constitution does not stipulate the number of Supreme Court Justices; the number is set instead by Congress. There have been as few as five, as many as 10. Number is capped by amendment at 30.

In Hawai'i, Judges have to retire at age 70. This has withstood scrutiny, so why can't we have Supreme Court Justices retire at 80 or 75 or 70? This would guarantee that there would be a turnover.
