In this quote, Alito essentially equates being gay to smoking crack and says no such right is rooted in “history.” I wonder what else the Puritans or old Torquemada opposed, you know, in “history,” which Alito thinks is so great. “Make America Spain in 1502 Again!”

If Alito gets a majority for his opinion in current form, the dissents are going to be very powerful. Saying women shouldn’t have rights today b/c it wasn’t custom & history in this country for men to grant them to them may not turn be the compelling argument he thinks it is.

In the draft opinion striking down Roe v. Wade, pp. 31-32, Justice Alito also seems to directly put two more precedents in peril:
Lawrence, granting the "right to engage in private, consensual sexual acts," and
Obergefell, granting the "right to marry a person of the same sex."

This is just Alito's draft & in the process of getting 5 votes, opinions can change. Nonetheless, that he's contemplating fully overruling Roe & returning women to 2nd class citizenship is absolutely appalling. No less devastating for knowing it was possibly coming.
The document leaked to Politico is almost certainly an authentic draft opinion by J. Alito that reflects what he believes at least 5 members of the Court have voted to support — overruling Roe. But as Alito’s draft, it does not reflect the comments or reactions of other Justices.
