Somewhat ironically, NYT v. Sullivan's actual malice standard appears to be what's keeping Fox News alive — for now — in the defamation suit brought by Dominion.

Next time they're havin' a catch with this guy they should maybe ask if he knows what happens to Fox News if he gets his way and Sullivan is overturned.

Michael Greene may still have to make an appearance at the fourth Oath Keepers trial -- as a defense witness. Stewart Rhodes' team called him during the first round and Donovan Crowl's attorney has indicated he'll likely be on her witness list for round four.
NOW: The Justice Department says it has decided NOT to retry Michael "Whip" Greene on the remaining felony count against him. "You're free to go," Judge Mehta told him just now.

NOW: A judge has declared a MISTRIAL on the one remaining count against Oath Keepers Jan. 6 ops leader Michael "Whip" Greene. A jury acquitted him of both conspiracy counts yesterday, and today said it was deadlocked on the final felony count. wusa9.com/article/news/natio…

It's likely a recognition from the DOJ that the evidence against Michael Greene isn't enough to win a conviction in front of any jury. No small thing, since he was the Oath Keepers' operations leader on Jan. 6. wusa9.com/article/news/natio…

Also, Judge Mehta is granting the DOJ's request to merge former Oath Keepers attorney Kellye SoRelle into the case with Donovan Crowl and James Beeks. Beeks is representing himself.

Another delay in the Proud Boys trial, it seems.
Replying to @rparloff
Judge: Another ill juror today. #0769. No reason to think the illness is serious and wouldn't be able to be present Monday. Given that it's a half hour, my thought is to not dismiss the juror, but I'll consult with you all. (The rest of the jury is here.) /15

Alright PR pros, my inbox is now wide open and ready to receive your most unhinged attempts to convince me the Trump indictment is the perfect opportunity to write about your client's new podcast/facial scrub/orthopedic sock.

Next witness in the Proud Boys trial is Anthony Guiffre, a U.S. Marine Corps veteran, former guard at Guantanamo Bay and Proud Boy. Called as a witness by Zachary Rehl.

Guiffre was added to the MOSD chat by Zach Rehl. His nickname was "Uncle Tony." He was part of both New Jersey and Philadelphia chapters of the Proud Boys and came to D.C. with the group for Jan. 6.

Question: How would you describe the Proud Boys' ability to organize? Guiffre: "Terribly... If anybody showed up at all who was sober they would get bonus points."

NEW: Former Boston police officer Joseph R. Fisher has been arrested and charged with assaulting a USCP officer on Jan. 6. Don't confuse him with former Pennsylvania police officer Joseph W. Fischer — also charged w/ assaulting police on Jan. 6. wusa9.com/article/news/natio…

As I note in the story, there are quite a few current and former police officers charged w/ assaulting law enforcement on Jan. 6. Oddly, nobody ever seems to think they're government plants. wusa9.com/article/news/natio…

Former West Virginia Proud Boys chapter leader Jeffrey Finley is asked by the defense about the PBs' "F*** antifa!" chant. "It's our number one chant," he says. Baffling why the FBI looked to the group when looking for sources of info about antifa.

Good article from the Post team about what we've learned over this week about the FBI informants who were around and inside the Proud Boys leading up to Jan. 6, and what the FBI wanted to hear about from them (hint: not the Proud Boys).
FBI sources inside the Proud Boys -- including one who testified yesterday that he went in the Capitol on Jan. 6 and has never been charged -- say FBI agents never actually asked them for information on the Proud Boys wapo.st/3lQu6dn

He testified he was given permission to commit minor offenses like spray paint vandalism *if it allowed him to collect info about antifa* and that everything he did at the Capitol was *because he was a Proud Boy.* Get your trial coverage from people who are actually here.
To Summarize: Today an FBI informant testified in the Proud Boys trial that he was given permission by the FBI to commit crimes, that he physically stopped a security gate from coming down in the Capitol, that he moved barricades, and he carried zip tie cuffs into the Capitol. 🚨
