Laws on hacking aren't universal, and even where laws are specific and constraining, they aren't uniformly enforced. It's really hard to get criminals and foreign intelligence entities to act as a plaintiff or victim of a crime as it turns out.

Not really. There is nothing legally preventing anyone from being charged for committing crimes against a criminal, just because the victim didn't come forward. "It's only legal if nobody decides to prosecutes you" is a great legal defense until it's not.
