I’m not sure how any observant person, regardless of how you feel about Roe, doesn’t think the SCOTUS is going to suffer a legitimacy crisis, just based on how the Court got its conservative supermajority alone.

Thus I'm skeptical about dark prophecies of a legitimacy crisis for the Supreme Court should it overturn Roe--or the coming electoral bloodbath for the GOP. Most people don't care about abortion as much as pro-choice Twitter. Many of those who do are on the other side.

Kavanaugh is using these arguments to claim that "returning abortion to the states" is the new middle ground. I think this is pretty clearly over. There are obviously five votes to overturn Roe v. Wade.
